In the context of music, copyright protection applies to both the musical composition (the melody, harmony, and lyrics) and the sound recording (the performance of the composition).
To be eligible for copyright protection music, a musical work must be original and fixed in a tangible medium of expression. This means that the work must be created by the author and not copied from someone else, and it must be recorded in some way, such as in sheet music, a recording, or a digital file.
Step 1 : Obtain and Fill “Form XIV”: The applicant must obtain Form XIV, which is the application form for copyright registration. The form can be downloaded from the copyright website of the Government of India or can be obtained from the Copyright Office.
Step 2 : Obtain No Objection Certificate (NOC): If the owner applies for copyright, he should file the NOC by the other authors, i.e. lyricist or composer or producer, if any, involved in making the song.
Step 3 : Send the Application: The application can be sent to the Registrar of Copyrights by post or can be filed online on the copyright website of the Government of India.
Step 4 : Notice to Interested Parties: The applicant must give notice to every person who claims to have an interest in the subject matter of the copyright.
Step 5 : Registrar’s Enquiry: If the Registrar is satisfied with the correctness of the particulars given in the application, and he receives no objection within thirty days of filing the application, they shall make an entry of the copyright in his Register. If dissatisfied with the correctness of the particulars made in the application, they shall hold an enquiry. The Registrar can accept/reject the application based on the enquiry and after giving an opportunity of being heard to the applicant.
Step 6 : Objection to Application: When the Registrar receives any objection to the application, an opportunity of being heard is provided to the parties. After making an enquiry and hearing to the parties, they may enter the particulars in the Register.
Step 7 : Registration of Copyright: The registration is complete when the Registrar signs the copy of the entry of the copyright in his Register.
